Pharmacy PSP Tool Terms of Use

Pharmacy PSP Tool (“Tool”) is an online resource for managing a Patient Support Program (“PSP”) intended for use by distributors (“Users” or “User”) participating in the PSP, which is created, administered and owned by Roche Georgia LLC, 10th floor 64 Ilia Chavchavadze Avenue Tbilisi 0162, Georgia (“Roche”).

Status of these Terms of Use

These Terms of Use (“ToU”) are deemed to be the standard contract terms under Article 342 of the Civil Code of Georgia. By registering with the Tool and using its functions the User provides unconditional acceptance of the ToU and is obliged to comply with the ToU.

No warranty and no liability

While Roche is making great efforts to include accurate and up-to-date information, we make no representations or warranties, express or implied, as to the accuracy or completeness of the information provided on this Tool and disclaim any liability for the use of this Tool or any site linked to it. Roche may change this Tool at any time without notice but does not assume any responsibility to update it. All Users agree that all access and use of this Tool and on any website linked to from this site and the content thereof is at their own risk. Neither Roche nor any other party involved in creating, producing or delivering this Tool or on any website linked to from this site shall be liable in any manner whatsoever for any direct, incidental, consequential, indirect or punitive damages arising out of your access, use or inability to use this Tool or any website linked to from this site, or any errors or omissions in the content thereof.

Information on the Tool

Information provided on this Tool is not intended to generate or support the interest of potential consumers and, therefore, does not meet the definition of "advertising" specified in the laws of Georgia. Information presented on this Tool is of a limited access nature (available only for Users) and is for purposes of the PSP only (registering and tracing patients) and may not be construed as a public offer or inducement to purchase goods, services or securities of Roche or other related parties, as well as should not be the basis for any decisions (including investment) by partners and customers of Roche.

Principles of conduct in the Tool

Users agree not to share anything which is false, vulgar, obscene, sexually-oriented, invading someone's privacy, or otherwise in violation of ANY law. Users accept responsibility for all data they add to the Tool. Users are not allowed to use data from the Tool for any purposes other than participation in the PSP. Disclosing, sharing or otherwise revealing personal data of a person without consent of such persons is strictly prohibited.

Intellectual property clause

All mentioned trademarks are owned by or licensed to a Member of the Roche Group. The Tool and the information contained and referenced herein are for purposes of the PSP only. Any reproduction, retransmission or other use is strictly prohibited. Request for permission to reproduce any information contained in this Tool should be addressed to Roche.

Tool’s rights

Roche, as an administrator of the Tool, is allowed to deactivate, ban, delete Users’ accounts in case of breach of these ToU. Any sanctions can be imposed on User(s) without prior notice.

Applicable law and dispute resolution

These ToU are governed by Georgian law. All disputes arising out of or in connection with these ToU are resolved under rules set by Georgia procedural laws.
